Disclaimer: In the event of any discrepancy between the English translation and the Norwegian version of the agreement and product terms and conditions, the Norwegian version shall prevail.

1. Definitions

1.1 Operator: “Operator” is a collective term for toll road companies and ferry companies that are part of the AutoPASS Cooperative.

1.2 AutoPASS: AutoPASS is the Norwegian system for electronic registration and payment of toll crossings, owned by the Norwegian Public Roads Administration (Statens vegvesen).

1.3 Toll Service Provider: A Toll Service Provider (TSP Company) is a company or other legal entity which, after approval pursuant to TSP Regulations § 21 or operational approval pursuant to § 22, enters into agreements with Operators and customers to provide services for payment of toll crossings and ferry transport through the AutoPASS Cooperative.

1.4 AutoPASS Cooperative: The AutoPASS Cooperative is the network for electronic registration and payment of toll crossings on public roads and ferry tickets on public ferry routes in Norway.

1.5 Agreement Passage: A toll or ferry crossing in Norway that is registered and assigned to the Customer’s agreement with the Company.

1.6 Tag Subscription: Delivery of a functioning electronic tag (“Tag”, see section 3) with an associated monthly cost charged to the Customer for having an agreement with the Company for AutoPASS with tag(s).

1.7 TSP Regulations: The Regulation on Toll Service Providers for toll collection and ferry tickets, which governs TSP activities for toll collection on the public road network in Norway and electronic ticketing through the AutoPASS Cooperative.

2. Special Terms and Conditions

2.1 This Agreement (“Agreement”) is an agreement between you as a private or business customer (“Customer”) and AutoSync AS as the AutoPASS Issuer (“Company”) regarding your use of the toll payment service provided by the Company in the AutoPASS Cooperative. The general terms and conditions for private or business customers also apply, but these special terms take precedence in the event of conflict.

2.2 The Agreement covers collection of payment for Agreement Passages as well as the Tag Subscription within the AutoPASS Cooperative. Agreement Passages include all crossings linked to the Customer’s Agreement, regardless of whether they are registered with a tag or by camera.

2.3 AutoPASS benefits will apply only from the time the order has been confirmed received and registered by the Norwegian Public Roads Administration. This may mean that some time passes between creation of the Agreement and the activation of the AutoPASS benefits. During this period, the Customer is responsible for toll and ferry crossings to the Operators without discounts or benefits.

3. Electronic Tag

3.1 The electronic tag (“Tag”) is used to register Agreement Passages in the AutoPASS Cooperative. The Tag is linked to the vehicle’s registration number and can be used at all automatic toll stations and ferry terminals in Norway. The Tag may also be used for other services adapted for use with the Tag, which have their own terms and conditions.

3.2 The Tag may also be used in several countries connected to EasyGo and EETS (European Electronic Toll Service), provided the Customer has entered into a separate agreement with the Company for this.

3.3 The Tag is issued by the Company when the Agreement is started. The Tag is the property of the Company. The Customer must replace lost or damaged Tags.

3.4 The Customer may register multiple Tags under the Agreement and is responsible for ordering or cancelling Tags via the Company’s customer portal. Each Tag is linked to a specific vehicle.

3.5 It is the vehicle’s registration number that must be listed under the Agreement—not personalized license plates.

3.6 Tags are tied to this Agreement and to the registered vehicle(s). The Customer may not transfer the Agreement to others.

3.7 The Tag must not be used in any vehicle other than the vehicle and registration number stated in the Agreement. The Tag must be mounted according to the Company’s instructions. Breach of this point is considered a material breach of the Agreement and may result in suspension or termination of the Agreement and fees for misuse, as well as the Agreement being charged for crossings registered with the Tag even if the Tag is placed in another vehicle.

3.8 To qualify for discounts and benefits under the Agreement, the Customer must place the Tag(s) in the correct vehicle and according to the Company’s mounting instructions.

3.9 Lack of or incorrect use of the Tag(s) results in increased costs and a higher risk of errors. The Company may therefore charge extra for Agreement Passages carried out with vehicles without a correctly installed Tag. The current rate for crossings without a Tag is presently NOK 0.

3.10 In the event of theft of the Tag, a documented police report and a written account of the incident are required before the Customer’s liability under the Agreement may be waived.

3.11 When selling or otherwise disposing of a vehicle, the Customer must update or terminate the Agreement information on the Company’s website. Until the notification of updated or terminated Agreement is confirmed received and registered by the Norwegian Public Roads Administration, the Customer remains liable for tolls registered to the vehicle and/or the Tag. The same applies if the Agreement is linked to a leased or otherwise controlled vehicle.

3.12 If no crossings have been registered on the Agreement for the past three years, the Company has the right to terminate the Agreement with immediate effect.

4. Rates and Discounts

4.1 Rates and discounts for use of the Agreement in toll and ferry systems are determined by public authorities. Information on rates and discounts can be found at autopass.no and on the websites of individual Operators.

5. Company’s Duties and Rights

5.1 The Agreement grants the Company the right and duty to collect payment for the Customer’s crossings in the AutoPASS Cooperative.

5.2 The Company shall ensure that information related to the Customer’s Agreement, including the Customer’s vehicle, is made available to the Operators. The Company provides the Tag so Operators can identify local agreements.

5.3 The Company has the right, but no obligation, to update information registered by the Customer based on data retrieved from public registers such as the Motor Vehicle Register or the National Population Register.

5.4 The Agreement may be transferred to another Toll Service Provider if the Company ceases its operations or stops issuing AutoPASS agreements. It may also be transferred in the event of mergers, demergers, or other business transformations. The Company shall in such cases notify the Customer no later than 14 days before the Agreement is transferred.

5.5 The Company will indemnify the Customer for loss of discounts or increased toll/ferry prices caused by errors by the Company or the Operator. The indemnification only covers lost discounts or increased prices caused by the error. Other costs, losses, or consequences of errors by the Company or the Operator cannot be claimed from the Company.

5.6 The Company may require financial security. The requirement must be proportionate to the documented economic risk the Customer represents.

5.7 The Company may suspend the Agreement if the Customer exceeds their credit limit or otherwise materially breaches the Agreement. The same applies if the Customer breaches chapter 3 regarding use of the Tag in another vehicle or provides incorrect or incomplete information.

5.8 Failure to pay is considered a material breach of the Agreement and may result in suspension or termination.

6. Customer’s Duties and Rights

6.1 The Customer is responsible for providing correct and complete information related to the Agreement, including vehicle information, and ensuring that all agreement-related information is kept updated at all times.

6.2 The Customer is entitled to discounts and possible exemptions according to applicable rate guidelines when crossings are registered and the Agreement is valid. The right to discounts or exemptions ceases if the Agreement is suspended or terminated.

6.3 The Customer is obliged to pay for all Agreement Passages registered and assigned to the Customer’s Agreement with the Company. The Customer’s payment obligation applies regardless of who uses the registered vehicle, and regardless of whether crossings are registered with a Tag or by photograph at a toll station or ferry terminal.

6.4 Full payment for Agreement Passages to the Company releases the Customer from further liability. The Customer’s payment obligation applies towards the Company. Detailed crossing information is available on the Company’s website.

7. Privacy

7.1 The following personal data may be processed by the Company, including received from Operators and the Norwegian Public Roads Administration:

a) Customer’s name, national identity number or D-number, other national ID numbers, contact information, and payment/invoicing information.
b) AutoPASS tag identification number.
c) Location, date, and time of passage.
d) Price class and price of passage.
e) Vehicle registration number.
f) Image of vehicle.
g) Registered owner and user in the Motor Vehicle Register.
h) Agreement number of the Customer’s Agreement.

7.2 If the Agreement is transferred to another AutoPASS Issuer, the personal data necessary to fulfil the Agreement may be disclosed. The Customer will be notified no later than 14 days before such a transfer.

7.3 The Company may disclose Customer information, including personal data, to Operators, collection partners, and the Norwegian Public Roads Administration as necessary to:

a) Determine correct toll rate or fee.
b) Handle Customer inquiries.
c) Transfer responsibility for payment to the Company.

7.4 Identification numbers for Tags and vehicle license plates may be disclosed to the Police, Norwegian Customs, and the supervisory authority in the Norwegian Public Roads Administration for checks under the regulation on electronic payment units in motor vehicles (over 3500 kg). For lighter vehicles, only the Tag identification number will be disclosed.

7.5 The Company may use data for analytical purposes and publish aggregated and anonymised statistics.

8. Termination of the Agreement

8.1 The Customer may terminate the Agreement at any time. The termination is effective from the date the Company receives the Customer's notification and the termination is registered in the AutoPASS Cooperative. The Company will process the termination without undue delay, normally within one to five business days. Otherwise, section 13 of the general terms applies.

8.2 The Customer acknowledges that the payment obligation under the Agreement ends only when the notice period has expired, all outstanding claims have been settled, and the deregistration has been confirmed and recorded by the Norwegian Public Roads Administration.
